These Terms & Conditions ("Terms") govern your use of friendyouneed, a peer emotional support platform operated by KAPT Ventures (AMRIT BAJAJ HUF), Delhi, India. By completing the registration consent process and using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not register or use the platform. These Terms are effective from 03 July 2026.

1. Nature of Service

friendyouneed is a peer emotional support platform operated by KAPT Ventures that provides audio-based conversations with trained listeners. We are NOT a licensed mental health service, therapy platform, psychiatric clinic, or medical provider. All sessions are conducted via secure in-app audio only. No video, no text therapy, no prescription services, and no clinical services of any kind are offered.

2. Listener Qualifications

Our listeners are trained in active listening, empathy, and emotional support practices. They are NOT licensed psychologists, psychiatrists, therapists, counsellors, or medical professionals. They must not be treated as such. Users must not request clinical guidance, diagnosis, or medical advice from them.

3. No Medical or Clinical Advice

Nothing communicated on this platform — by listeners, in written content, or through any other channel — constitutes medical advice, psychiatric diagnosis, clinical treatment, or a substitute for professional healthcare. For any medical condition, mental health disorder, or psychiatric concern, please consult a qualified healthcare professional immediately.

If you are in crisis or in immediate danger, please contact your local emergency services or a licensed crisis helpline immediately. friendyouneed is not an emergency service.

4. Account Registration

• You must register with a valid, verified email address.
• Users in India must also provide and verify a mobile number. International users are not required to verify or provide a mobile number.
• Your display name must be a nickname — your real name is not required and is never publicly visible.
• You must be 18 years or older to register. By completing the registration consent checklist, you are making a self-declaration that you meet this age requirement. Under India's DPDP Act 2023, processing data of users under 18 requires verifiable parental consent. KAPT Ventures does not accept registrations from users under 18.
• A timestamped record of your consent declaration is retained by KAPT Ventures for legal compliance purposes.
• You are responsible for maintaining the security and confidentiality of your account credentials.

5. Session Booking

Sessions are available through Scheduled Booking: browse available listener slots and confirm your session in advance. All sessions take place via secure, closed in-app audio. No phone numbers are exchanged between users and listeners at any point.

Immediate sessions are not currently offered. If you have an urgent need, you may send a message and we will endeavour to respond as soon as possible.

6. User Responsibilities

By completing the registration consent process and using friendyouneed, you agree to:

• Be 18 years of age or older.
• Not use this platform as a substitute for emergency services or professional clinical care.
• Treat all listeners with respect. Abusive, threatening, or harassing behaviour will result in immediate session termination and permanent account suspension.
• Not share your personal contact details with listeners or attempt to contact listeners outside the platform.
• Not request prescriptions, clinical assessments, diagnoses, or professional medical guidance from listeners.
• Not share another user's or listener's personal information.
• Not misrepresent your age or identity during registration. Falsely declaring that you are 18 or older when you are not constitutes a breach of these Terms and may constitute a legal offence under applicable law. In such cases, all legal liability shifts entirely to the user.

7. Confidentiality

All sessions are strictly confidential. The only exceptions are situations where there is a credible, immediate risk to the life of the user or another person, in which case we may be required by law to take appropriate action. This exception applies in all jurisdictions where we operate.

8. Consent & Withdrawal

Your use of this platform is based on the informed consent you provide at registration. You may withdraw your consent at any time by requesting deletion of your account. Withdrawal of consent will result in account deactivation and deletion of all stored data within 7 days. Withdrawal does not affect the lawfulness of any processing carried out before withdrawal.

9. Limitation of Liability

KAPT Ventures (operating as friendyouneed) is not liable for any outcomes, decisions, or actions resulting from conversations on the platform. This service provides supplemental emotional support only — it is not a substitute for professional, clinical, or emergency care. To the maximum extent permitted by applicable law, our liability is limited to the amount paid by you for sessions in the 30 days preceding the claim.

10. Prohibited Use

The following are strictly prohibited:

• Requesting or pressuring listeners to provide clinical, medical, or psychiatric advice.
• Sharing another person's session details or personal information.
• Using the platform to harass, intimidate, or abuse any person.
• Attempting to identify, contact, or meet a listener outside the platform.
• Misrepresenting your age or identity during registration.
• Using the platform for any unlawful purpose.

 

11. Termination

KAPT Ventures reserves the right to suspend or terminate access immediately for misuse, abuse of listeners, provision of false information during registration, or any violation of these Terms, without refund where applicable.

12. Governing Law & Dispute Resolution

These Terms are primarily governed by the laws of India. KAPT Ventures is the legal entity responsible for the friendyouneed platform. For users outside India, applicable local consumer protection laws may also apply and are not excluded by this clause. Any disputes shall be subject to the exclusive jurisdiction of courts in Delhi, India, subject to mandatory local law requirements in your jurisdiction.

13. Changes to These Terms

We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.

14. Refund Policy

Sessions cancelled at least 24 hours before the scheduled time are eligible for a full refund or credit. Cancellations made within 24 hours of the session are non-refundable. In the event of a technical failure attributable to our platform, a full credit or refund will be issued.
